Consulting the online catalogs allows you to browse all the works before the sale, identify the lots that interest you, and prepare your bid.
In person, during our exhibitions held on Saturdays and Sundays, from 10:00 AM to 6:00 PM, at our partner Embelco, an art transport company located at Woluwelaan 147, 1831 Diegem (Brussels). These exhibitions allow you to physically examine the objects, assess their condition, and discuss the characteristics of the works with our team.

In person: Sales are public and open to everyone. You participate directly in the auction room by raising your hand or indicating your intention to bid.
With an absentee bid: If you cannot attend the sale, you can entrust us with a maximum amount. We will bid on your behalf up to this limit, strictly adhering to your instructions.
By telephone: You can request to be called during the sale. A member of our team will contact you when the lot is presented and will bid on your behalf. This request must be confirmed no later than 24 hours before the sale.
Via the Drouot platform: Sales are broadcast live on the Drouot website. After registering, you can follow the sale in real time and bid from your computer or phone.
At the beginning of each auction, the auctioneer reviews the conditions relating to the buyer. Each lot is then announced by the auctioneer. The starting price is based on the estimate or set in agreement with the seller. The public can then begin bidding. The pace is adjusted to the bids made. The auction ends when the highest bid is no longer contested. The lot is then awarded at that price.
These general terms and conditions apply to all public auctions organized by Galerie Moderne SRL (Chaussée de Waterloo, 414, 1050 Brussels, BCE 1028.208.611). They are included in the catalog, on the website, on the written bid and telephone bidding request forms, and are reiterated at the beginning of the sale. All buyers are deemed to have read and accepted them.
The sale is made to the highest bidder. The successful bidder becomes the buyer. In case of dispute, the bailiff or auctioneer may decide to resell the lot. Every buyer acts in their own name, even if purchasing as an agent. They must provide their full contact details and, if necessary, bank details.
Lots are sold with their imperfections, defects, and any errors in description. Galerie Moderne is not responsible for errors in attribution, authenticity, condition, or dating. The buyer must examine the lots during the viewings. After the auction, no claims will be accepted.
The buyer must confirm their request 24 hours before the sale and provide their information. Galerie Moderne is not responsible for errors in lot numbers or technical problems. If two identical bids concern the same lot, the first one received takes precedence.
The buyer pays the hammer price plus a 28% buyer's premium (including VAT).
Applicable according to current legislation for works of art exceeding €2,000 excluding VAT, according to a progressive scale. The resale right may be claimed even after the sale if its application is subsequently discovered. The buyer agrees to pay it upon first request.
Risk passes to the buyer upon the fall of the hammer. Payment must be made within five days of receipt of the invoice. Payments are to be made in EUR, electronically. Cash payments are not accepted. VAT is included in the price.
Lots must be collected within seven days of the sale and after full payment. A storage fee of €5 per lot per day will be charged thereafter. Transport and risks associated with collection, packing, or handling are the responsibility of the buyer.
In the event of non-payment or non-collection, a late payment interest of 2% per month will automatically apply. Galerie Moderne may take various measures: storage at the buyer's expense, legal action, cancellation of the sale, resale of the lot, etc.
In the event of a dispute, only Belgian law applies. The courts of Brussels have jurisdiction.
If you are the highest bidder at the end of the auction, the prize is awarded to you. You will then receive a confirmation email containing instructions for payment and collection.
